The ruling of the EU Court of Justice changes e. communication data collection rules

The European Union Court of Justice has ruled that EU governments cannot oblige e.communications companies to collect and store users’ data.

Firm’s partner Aurelija Rutkauskaitė comments to Lithuanian business news portal Verslo žinios that this decision radically changes the rules of the game. According to this court decision, it can be stated that the mass collection of e.communications data violates human rights and EU law.

Until now, most EU countries, including Lithuania, have provisions in their national laws that oblige e.communication service providers to store data, including local and metadata, without any selection due to the prevention of serious crimes and national security.
