TRINITI JUREX represented a client during a Migration Department compliance check assessing whether an employee’s salary met the statutory requirement of 1.5 BDU (EUR 3,020.70).

The Migration Department indicated that the employee’s monthly salary over the previous three months may have fallen below the required threshold and requested explanations and supporting documents, warning that such circumstances could have direct implications for the validity of the employee’s temporary residence permit.

In practice, such situations are highly sensitive – even technical or administrative discrepancies may trigger a review of migration status.

TRINITI JUREX prepared a detailed, legally grounded response and submitted all relevant documentation. It was established that the discrepancy resulted from an accounting error, which was promptly corrected – the outstanding salary was paid together with late payment interest in accordance with labour law requirements.

This case illustrates that migration compliance is not limited to complex court disputes, but also includes day-to-day business operations, where a fast and legally precise response can prevent serious consequences, including risks to the validity of a temporary residence permit.
