Triniti Jurex successfully defended client Transoila in a dispute with Belintertrans Baltic, a company linked to the illegitimately elected and internationally sanctioned President of Belarus, Alexander Lukashenko. Belintertrans Baltic took Transoila to court for a debt, a fact the company did not deny. However, fulfilling this obligation was impossible as long as the creditor remained under sanctions.
This case demanded insightful work from the Triniti Jurex team in interpreting international sanctions law within the framework of legislation governing sanctions against Belarusian entities. The court upheld the position of Transoila, emphasizing that the company’s ability to fulfil its contractual obligations is objectively limited by the sanctions imposed by the European Union, and therefore dismissed Belintertrans Baltic’s claim.
