Kliendi kinnistule oli seatud h\u00fcpoteek, h\u00fcpoteegipidaja oli likvideeritud ja \u00e4riregistrist kustutatud. Vastavalt kohtupraktikale ei too \u00e4ri\u00fchingu kustutamine registrist automaatselt kaasa sellele \u00e4ri\u00fchingule kuuluvate asja\u00f5iguste (sh h\u00fcpoteegi) l\u00f5ppemist. St h\u00fcpoteegi kustutamiseks on vajalik h\u00fcpoteegipidaja n\u00f5usolek ning kinnistu omanikul tuleb taotleda kohtu kaudu \u00e4ri\u00fchingu t\u00e4iendava likvideerimise l\u00e4biviimist. Kohus saab otsustada \u00e4ri\u00fchingu t\u00e4iendava likvideerimise ja ennistada vanade likvideerijate \u00f5igused v\u00f5i m\u00e4\u00e4rata uued likvideerijad. Seda juhul, kui \u00e4ri\u00fchingul j\u00e4i jaotamata vara ja t\u00e4iendavad likvideerimisabin\u00f5ud on vajalikud, v\u00f5lausaldaja avalduse puhul n\u00e4eb seadus ette t\u00e4iendavad kriteeriumid. Seadus s\u00e4testab huvitatud isikuna s\u00f5naselgelt v\u00f5lausaldaja, kuid vastavalt kohtupraktikale on huvitatud isikute ring laiem, selleks saab olla ka nt h\u00fcpoteegiga koormatud kinnisasja omanik.
