Klient soovis kaasomandis oleva maja m\u00fc\u00fcki avalikul enampakkumisel, teine kaasomanik aga maja j\u00e4tmist endale, kuid oluliselt v\u00e4iksema h\u00fcvitise eest, kui pool kohtuekspertiisiga tuvastatud turuv\u00e4\u00e4rtusest. Kohus selgitas, et p\u00f5him\u00f5tteliselt ei ole \u00f5ige j\u00e4tta kaasomandis olevat kinnisasja \u00fche kaasomaniku ainuomandisse suurema h\u00fcvitise maksmise vastu, kui viimane on valmis ja v\u00f5imeline maksma. Vastaspool ei olnud t\u00f5endanud, et ta oleks v\u00f5imeline \u00f5iglast h\u00fcvitist maksma. Kohus selgitas \u00fchtlasi, et ainu\u00fcksi asjaolu, et vastaspool kasutab kaasomandisse kuuluvat maja oma elukohana, ei \u00f5igusta meie kliendi ilmaj\u00e4tmist talle kuuluvast omandist tingimustel, mille puhul ta ei saa omandi kaotuse eest \u00f5iglast ehk turuv\u00e4\u00e4rtusel h\u00fcvitist.\u200b Maakohtu otsus ei ole veel j\u00f5ustunud.
