Advokaadib\u00fcroo TRINITI esindab k\u00e4imasolevas kohtuvaidluses peat\u00f6\u00f6v\u00f5tjat, kelle arvelduskontod arestiti \u00fcllatuslikult allt\u00f6\u00f6v\u00f5tja taotluse alusel ja olukorras, kus kohtumenetlus oli kestnud ca aasta. M\u00e4rgime, et hagi tagamiseks peavad esinema m\u00f5juva p\u00f5hjused ning kontode arest on \u00fcks k\u00f5ige erandlikemaid meetmeid, kuiv\u00f5rd see on menetlusosalisele \u00e4\u00e4rmiselt koormav. Meil \u00f5nnestus klient p\u00e4\u00e4sta alusetust hagi tagamisest ca 20 p\u00e4evaga olukorras, kus perioodi j\u00e4id ka j\u00f5ulud ja aastavahetus.<\/p>\n

Nimelt avastas klient t\u00f6\u00f6n\u00e4dala alguses, et ettev\u00f5tte kontod on kohtumenetluse raames arestitud. P\u00f6\u00f6rdusime koheselt p\u00e4ringuga maakohtu poole, kuid maakohus keeldus hagi tagamise m\u00e4\u00e4rust v\u00e4ljastamast p\u00f5hjendusega, et k\u00f5ik krediidiasutused ei ole kohtule veel m\u00e4\u00e4ruse t\u00e4itmise osas vastanud. Arvestades olukorra kriitilisust (arved vajasid maksmist ja t\u00f6\u00f6tasud \u00fclekandmist) ning p\u00f5him\u00f5tet \u201e\u00e4\u00e4rmuslikud olukorrad n\u00f5uavad \u00e4\u00e4rmuslikke lahendusi\u201c, tegime midagi erakordset – vaidlustasime kohtum\u00e4\u00e4ruse, mille sisu me ei olnud n\u00e4inud.<\/p>\n

Ringkonnakohus t\u00fchistas TRINITI m\u00e4\u00e4ruskaebuse alusel maakohtu m\u00e4\u00e4ruse ning n\u00f5ustus meie argumentidega, et kontode arest on toodud asjaoludel p\u00f5hjendamatu ja menetlusosalist liigselt koormav. Ringkonnakohus n\u00f5ustus, et allt\u00f6\u00f6v\u00f5tja ei ole toonud kohtu ette asjaolusid, mis kaaluksid \u00fcle TRINITI kliendi huvid ja \u00f5igustaksid majandustegevuse niiv\u00f5rd ulatuslikku piiramist. Seega k\u00e4esoleval juhul oli \u201ekastist v\u00e4lja\u201c m\u00f5tlemine edukas ning v\u00f5imaldas tekkinud olukorra lahendada erakordselt kiiresti ja tulemuslikult.<\/p>\n
