Katri Tomson, head of TRINITI’s finance practice group and a member of the FinanceEstonia board, participated in a joint session of the Riigikogu’s Constitutional Committee and Legal Affairs Committee, where the topics of responsible lending and judicial proceedings regarding consumer credit claims were discussed.
At the joint session held on May 4, the interest groups were involved regarding the preparation for the second reading of the draft Act Amending the Courts Act and Other Acts (Acceleration of Court Proceedings) (854 SE). The bill was aimed to significantly limit the possibilities for enforcing consumer credit claims through the courts, a move that drew sharp criticism from market participants’ representatives. According to the financial sector, the planned changes will not reduce the burden on the courts but will instead place an even greater burden on them. The constitutionality of measures restricting creditors’ claims was also called into question.
Also invited to the hearing were Martin Länts, the head of the FinanceEstonia practice group of the creditors; Jüri Puust, the legal counsel at Swedbank and member of the Estonian Banking Association’s loans practice group; Merle Laurimäe, the CEO of Julianus Inkasso; Siim Juks, the member of the board of the Estonian Credit Providers Association; Martin-Johannes Raude, the chair of the Procedural Law Committee and a representative of the Estonian Bar Association; Villu Kõve, the Chief Judge of the Supreme Court; Ivo Pilving, the member of the Supreme Court; Mario Truu, the Chief Judge of the Tartu Circuit Court; Liina Naaber-Kivisoo, the Chief Judge of the Harju County Court; Kaupo Kruusvee, the Chief Judge of the Tallinn Administrative Court; Ene Andresen, the Chief Judge of the Tartu Administrative Court; Anu Uritam, the Head of the Estonian Association of Judges; and representatives of the Chamber of Notaries and the Ministry of Justice and Digital Affairs.
