Successful conclusion of ad hoc international arbitration over cross-border organic agricultural commodities supply contracts

TRINITI JUREX successfully represented one of Lithuania’s largest suppliers of organic agricultural commodities in an ad hoc arbitration under the UNCITRAL arbitration rules arising from three cross-border organic oat supply contracts concluded with a buyer in Italy.

The dispute arose from the buyer’s failure to pay for goods duly delivered and involved complex issues relating to the quality, conformity and organic certification of agricultural commodities. The case also raised significant legal questions, concerning arbitral jurisdiction, the validity and scope of the arbitration agreements, the authority of a company’s representative to conclude the contracts, and the subsequent ratification of those contracts through the parties’ conduct.

The matter was further complicated by its cross-border dimension. Before the arbitration commenced, the parties had been involved in court proceedings in Italy, where the Italian court set aside a payment order and referred the parties to arbitration in Lithuania. TRINITI JUREX attorneys-at-law Evaldas Pocevičius, Ieva Gailiūtė and Ingrida Kryžauskienė developed and implemented a coordinated cross-border dispute resolution strategy, successfully addressing both procedural issues, including the appointment of an arbitrator with the assistance of the Lithuanian courts and substantive legal issues arising from the previous litigation.

In the final days of July 2026, the arbitral tribunal rendered an award fully upholding the client’s claims, ordering recovery of the outstanding debt in full together with interest and the costs of the arbitration.
